1. Basic Policy

ES-CON JAPAN Ltd. (“the Company” hereinafter; consolidated subsidiaries included in the annual securities report shall be referred to as “Group Companies” hereinafter) will handle personal data appropriately at all times, in full compliance with the Act on the Protection of Personal Information and other applicable laws and regulations, as well as guidelines issued by the Personal Information Protection Commission and by other entities.

3. Collection and Use of Personal Information

When collecting personal information, the Company will make public or indicate the purposes of use (including the information provided in this policy). When collecting personal information directly from the subject of the information (this term refers to the particular individual identified by such personal information) through contracts or other documents, including electromagnetic records, the Company will specify the purposes of use in advance and collect information by fair and lawful means. The Company will use personal information appropriately and to the extent necessary to achieve the purposes of use. The Company may use personal information outside the stated scope of the purposes of use where permitted by the Act on the Protection of Personal Information or other laws or regulations. The Company will not use personal information in ways that may facilitate or induce unlawful or unjust conduct.

4. Purposes of Use of Personal Information

The Company's business objectives are to pursue the following businesses and to control or manage the business activities of the Group Companies engaged in the following businesses. The Company will use personal information (except for specific personal information) for these business objectives.

Specific purposes of use for specific individuals
To achieve the business objectives specified above, the Company will use personal information on or concerning the specific individuals below (collectively, all individuals specified in [1] through [5] may be referred to as the “Customers or other parties”) for the purposes specified below.

- To enable customer identity verification and personal authentication
- To extend offers and proposals to customers
- To handle, confirm, and record customer inquiries, calls for advice, complaints, and customer repairs and customer support
- To send commodities, bills, free gifts, etc. related to campaigns in which customers have chosen to participate
- To develop products and develop and enhance services
- To improve and enhance the customer’s experience of digital services provided by the Company and Group Companies (e.g., websites and mobile apps)
- To advertise and provide information on products, services, and campaigns by means of invitations, e-mail, etc.
- To distribute targeted advertising via ad delivery businesses such as Google
- To analyze attribute information, behavior, history, etc. collected by the Company and Group Companies to identify customer interests, preferences, etc.

- To establish contacts, execute contracts, and undertake business negotiations to the extent required for operational reasons
- To manage customer information

Personal information on or concerning Customers or other parties collected from third parties other than the Company and the Group Companies may be used in conjunction with, or as linked to, personal information on or concerning customers already in the possession of the Company or Group Companies.

5. Personal Data Safety Control Measures

The Company will implement safety control measures necessary and appropriate for the management of personal data, including, but not limited to, the prevention of its leakage, loss, or damage. The Company will also exercise necessary and appropriate supervision over employees and contractors (including subcontractors) who handle personal data. Safety control measures for personal data are specified in separate internal rules, including internal rules on the protection and management of personal information. These measures include the following, among others.

To ensure the proper handling of personal data, this policy (Privacy Policy) has been established as the basis for “Compliance with Relevant Laws and Regulations, Guidelines, etc.” and “Inquiry Desk for Receiving Questions and Complaints.”

Internal rules on protection and management of personal information
The Rules for Handling Personal Information and other internal rules have been established to specify proper procedures, assign responsibilities, specify authorized individuals, and specify what duties such individuals assume in connection with the collection, use, storage, provision, deletion, and disposal of personal information. They provide for the following measures.

- Implement measures to prevent the theft, loss, etc. of devices, electronic media, and documents etc. used to handle or in the handling of personal data; implement measures to prevent the ready disclosure of personal data when such devices, electronic media, etc. are carried about, including inside company facilities, condominiums, or detached houses under construction or offered for sale

- Implement access controls to limit the scope of authorized individuals and of personal information databases that they can access
- Introduce systems to safeguard the information systems used to handle personal data from unauthorized external access or unauthorized software, including malware

Supplementary information: “Personal Information” and “Personal Data”

Individual customers
Personal information” refers to information concerning a living individual, such as name, birth date, and so forth, from which that particular individual can be identified. It also refers to information containing personal identification codes.
Personal identification codes” include information such as fingerprints, DNA, the skeletal structure of the face and other physical features data, My Number, passport number, driver's license number, and other public numbers assigned to a certain individual.

What is personal data?
Personal data” refers to personal information held in a “personal information database.” “Personal information database” refers to a collection of information, including personal information, systematically structured to allow the retrieval of certain personal information. Specifically, if personal information is organized and classified by certain rules and is arranged in a certain order by means of a list of contents, indexes, and so forth, thereby enabling ready retrieval of certain personal information, such collection constitutes a “personal information database,” whether it is managed by computer or on paper.

6. Sharing of Personal Data

The Company will share personal information regarding the Customers or other parties described in “4. Purposes of Use of Personal Information” above, as follows.

Items of personal information
Addresses, names, postal codes, telephone numbers, facsimile numbers, email addresses, etc. of the Customers or other parties

Scope of sharers
- Chubu Electric Power Co., Inc., Chuden Real Estate Co., Inc., the Company, the Group Companies
- Business operators engaged in business partnerships, business outsourcing, subcontracting, equipment delivery and aftersales services, etc. in relation to the acquisition of real estate, construction and sale of buildings etc., and other businesses falling under 4.(1) conducted by Chubu Electric Power Co., Inc., Chuden Real Estate Co., Inc., the Company, and the Group Companies
- Other businesses with which Chubu Electric Power Co., Inc., Chuden Real Estate Co., Inc., the Company, and the Group Companies work (e.g., life insurance companies, property insurance companies, banks) or engage (e.g., ad delivery companies) for the “4. Purposes of Use of Personal Information” above

Data sharing will take place within the limits of “4. Purposes of Use of Personal Information” above.

The Company is responsible for shared personal data. For the Company's address and representative, please see 2 above.
Submit inquiries about data sharing by the Company and Group Companies to the department specified in “13. Inquiries (Department in Charge)” below.

7. Supervision of Employees and Contractors

When its employees handle personal data, the Company will exercise all necessary and appropriate supervision to ensure the security of the data. Should the Company entrust the whole or any part of personal data handling processes to a contractor, the Company will exercise all necessary and appropriate supervision to ensure the security of the entrusted data.

8. Provision of Personal Data to Third Parties

The Company will not provide personal information in its possession to any third parties except in the following cases:

  • The Customer or other parties have provided consent in advance.
  • A contractor is engaged to the extent necessary to achieve the purposes of use.
  • Such provision is required by laws or regulations.
  • Such provision is required to protect human life, to prevent injury, or to protect property under circumstances in which obtaining customer consent is difficult.
  • Such provision is deemed especially pressing in the interests of improving public health or promoting the healthy development of children under circumstances in which obtaining customer consent is difficult.
  • The acquisition of the customer's consent appears likely to hinder the fulfillment of statutory affairs by the national or local government in cases in which the Company is compelled to cooperate.
  • Such information is provided to the persons included in the scope of sharers in 6 above.

9. Ensuring the Accuracy of Data etc.

The Company will keep personal data accurate and current to the extent necessary for the purposes of use. The Company will strive to delete personal data without delay when it is no longer needed.

10. Disclosure of Retained Personal Data

Should the Company receive requests from the Customers or other parties for the disclosure of personal information (including the disclosure of records of personal data provision to third parties) pursuant to the provisions of the Act on the Protection of Personal Information, the Company will, after verifying that such requests are made by the actual subjects of the information, promptly make the disclosure to the subjects of information without delay. (If the Company holds no relevant personal information, the Company will provide notification to this effect.) This provision shall does not apply if the Company is not required to make such disclosures under the Act on the Protection of Personal Information or other laws or regulations. Please note a fee (1,500 yen per disclosure) is charged for the disclosure of personal information.

11. Correction and Suspension of Use of Retained Personal Data

The Company strives to keep personal data accurate and current. Should the subject of any information notify the Company of inaccuracies in the retained personal data, the Company will review the information and make any necessary corrections, additions, or deletions (“Corrections, etc.” hereinafter ). In addition, should the Company receive a request from a subject of the information to suspend the use of or to erase the retained personal data from which the subject of the information can be identified (“Suspension of Use, etc.” hereinafter) on the grounds that the handling of the retained personal data is beyond the scope of the purposes of use or was collected by wrongful means, the Company will review the particulars and, if such request is found to be factual, effect the Suspension of Use, etc. of the retained personal data.

The Company will also suspend the provision of the retained personal data to third parties (including sharing under 6 above) after reviewing the request from the subject of the information. Please note, however, that if the Suspension of Use, etc. of retained personal data is effected, the Company may no longer be able to provide certain services to the user. Please submit inquiries regarding correction and/or Suspension of Use of retained personal data to the inquiry desk specified below.

12. Reporting Leakage or Other Incidents.

In the event of personal data leakage, loss, or damage, the Company will submit the necessary reports in accordance with the provisions of the Act on the Protection of Personal Information and other laws and regulations, notify the subjects of the information concerning such incident, or take appropriate alternative measures in lieu of such notification.
