ES-CON Japan Ltd. (hereinafter the “Company”) complies with the Act on the Protection of Personal Information and other related laws and regulations and strives to ensure proper handling and safe management of personal information as follows.

Handling of Personal Information

The ES-CON Group is involved in the planning, development and sales business of for-sale condominiums, commercial facilities, etc., leasing business of owned properties, property management business, for-sale condominium management business, entrustment of real estate-related business, planning, brokerage and consulting business as well as real estate investment advisory business.

Collection of Personal Information

The Company uses personal information for the following purposes

Sales, leasing, management and brokerage of real estate and other incidental business

Insurance business (including insurance agency business and insurance service)

(3)

Operating activities regarding each business in (1) and (2) above (sending postal items and e-mails, making phone calls, visiting, etc.) and analysis of customer trend or survey and analysis of product development, etc.

(4)

Provision to third parties including partner companies and affiliated companies within the scope necessary for achieving the goals of (1) to (3)

Provision of Personal Information to Third Parties

The Company, in accordance with legal regulations, and within the scope necessary to achieve the above purpose of use, may provide personal information to third parties such as partner companies and affiliated companies, as follows.

Information provided may include name, address, telephone number (include mobile phone numbers), property information, age, date of birth, gender, email address, annual income, occupation, purpose of purchase, contract data, other data within the scope necessary to achieve the above purpose of use.

(2)

Means of provision may include digital data, written materials such as mailing labels or survey forms, or lists.

(3)

We will, at the request of the individual, stop providing information to third parties such as partner companies and affiliated companies. However, if we stop using such information, users should be aware there may be services that we are no longer able to provide.

Use of Cookies

Disclosure of Personal Information

The Company will disclose personal information in accordance with the prescribed procedures when requests are made from the individual. Please refer to the following for the procedures. Furthermore, the individuals are required to pay the expenses prescribed upon disclosure of personal information.

Correction and Suspension of Use of Personal Information

The Company strives to keep the content of personal information both accurate and current. If the individual notifies that the information is inaccurate, the Company will correct the information after confirming the content. In addition, when a request to stop the use of personal information is made by the individual due to handling of personal information outside the scope necessary for achieving the purpose of use and improper acquisition of personal information, the Company shall stop the use of personal information after confirming the content. Furthermore, the Company shall stop the provision of personal information to third parties after confirming the content when such request is made by the individual. However, if the provision of such information is stopped, users should be aware there may be services that the Company is no longer able to provide. Inquiries concerning correction and suspension of use of personal information can be made at the inquiry counter described below.

Personal Information Disclosure Procedure

To make a request for disclosure, please fill in the necessary items in this Disclosure Application, enclose the personal identification documents (proxy identification documents if applying by proxy) and fee, and send it to the Information Desk for Handling of Personal Information. We will disclose the personal information in written form and send it to the address indicated on the certificate of residence through delivery restricted to the addressee. To request a Disclosure Application, please contact the same information desk. We will send it by mail, fax or email. It can also be downloaded from the link below.

Please read the following stipulations before contacting us requesting disclosure.

- Personal information may not be disclosed if all necessary documents have not been submitted.

- Personal information will not be disclosed if payment of the fee, etc. associated with the request for disclosure is not made.

- Please note that it may take time to provide disclosure materials due to verification procedures.

- In the event that investigation reveals that we do not have the personal data on the subject, notification shall be made but the fee, etc. shall not be refunded.

- Personal information shall not be disclosed in whole or in part when there is a risk of harm to the life, body, property or other rights or interests of the individual or any third party, when significant impediment is caused to our business or when laws and regulations are violated. The fee, etc. shall not be refunded in such cases.

- Personal information provided through this procedure shall be used within the scope necessary for performing disclosure procedures such as conducting personal identification, verifying personal data and contacting the individual or applicant (proxy). Furthermore, the application documents will not be returned.

Basic Policy Concerning Appropriate Handling of Specific Personal Information, etc.

The Company has established the Basic Policy to ensure appropriate handling of specific personal information, etc. as an organization.

The Company complies with the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (Act No. 27 of 2013, “My Number Act”), Act on the Protection of Personal Information (Act No. 57 of 2003, the “Personal Information Protection Act”) and “Guideline Concerning Appropriate Handling of Specific Personal Information (for Private Entities),” and appropriately handles specific personal information.

With regard to safety control measures of specific personal information, the Company has established the “Rules for Handling Specific Personal Information” and “Manual for Handling Specific Personal Information” and implements organizational safety control measures, personal safety control measures, physical safety control measures and technical safety control measures.
